DISCLAIMER OF PERFORMANCE
Once the ZenTune tuning box has been installed in your vehicle, the driver is ultimately responsible for the increased power, torque, and speed acquired.
By installing this product, the customer understands and agrees that, as a high-performance product, individual results may vary depending on the make, model, and usage.
The customer also understands that the original vehicle manufacturer makes its own determinations regarding the effects of add-on products and/or services on its warranties. ZenTune shall in no way be held responsible or liable for anything related to or resulting from the original vehicle manufacturer's warranty and/or terms of use.
While fuel savings are common with our tuning boxes, they depend on your individual driving style and therefore cannot be guaranteed.
DISCLAIMER OF LIABILITY
The buyer acknowledges and agrees that the disclaimer of any liability for personal injury is a material term of this agreement. The buyer agrees to indemnify and hold the seller harmless from any claim related to the item, equipment, or service purchased.
ZenTune assumes no liability regarding the improper installation or misapplication of its products and/or services. It is the installers responsibility to ensure proper installation, and if in doubt, our Technical Department should be contacted.
It is your responsibility to inform your insurance company of this modification. This modification may affect your premium, so we advise that you contact your insurance company before carrying out the installation to be fully aware of any additional costs you may incur. It is your responsibility to comply with all applicable federal and state laws related to the use of equipment supplied by ZenTune, whether for on-road, off-road, or public highway use. ZenTune hereby disclaims any liability resulting from the failure to use our products in compliance with all applicable federal and state laws.
By installing and/or using our products, you agree to the terms of use stated above.
BUSINESS CUSTOMERS
ZenTune shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill, or otherwise), costs, expenses, or other claims for consequential compensation whatsoever (however caused) arising out of or in connection with this agreement.
Consumer Rights
This agreement does not affect any statutory rights you may have as a consumer. Under the Distance Selling Regulations, consumers generally have a "7 days cooling off" period during which they can cancel contracts for goods or services purchased online.
Returns and Refunds
If you wish to return your product, our 30-day return policy allows you to return products under certain conditions: Notify us in writing.

Ensure we receive the returned product within 30 days from the purchase date.
Returned goods must have any labels still attached and be in condition, meaning they should be clean, free from marks or scratches, and suitable for resale. If the goods are returned in a condition other than sold, we reserve the right to offer a partial refund.
A handling/admin fee of $10.00 will be deducted from the total refund amount. Any additional or optional postal charges will not be refunded. Customs duties, taxes, or extra fees incurred will be charged to or deducted from the final refund.
We will process your refund as soon as possible and, in any case, within 30 days of receiving your valid cancellation notice. Visit our Privacy Policy page for more details.
Force Majeure
In this context, force majeure event refers to:
- Any event beyond our reasonable control
- Hacker attacks, viruses, or other malicious software
- Issues with the internet or third-party internet service providers
- Power failures, industrial disputes, governmental regulations, fires, floods, disasters, civil riots, terrorist attacks, or wars
If a force majeure event causes a delay or failure in fulfilling our obligations under this agreement, those obligations will be suspended for the duration of the event.
Product Not as Described
If you find that a product is not as described, please report the issue to our Technical Support Department within 7 days of purchase. Provide clear evidence that the product differs from its description on our website. Complaints based solely on incorrect expectations or wishes will not be honored.
Warranty
All products supplied by ZenTune are covered by a 5-year warranty from the date of supply. This warranty includes coverage for internal components, casing, and harness. Despite rigorous testing before release, unforeseen errors may occur. Such issues must be reported to our Technical Support Team for approval. We reserve the right to address the error or defect promptly. If a fault is identified, we will offer either a repair or replacement of the product.
Exclusions from Warranty:
1. Intentional damage, failure to follow ZenTunes instructions, or any alteration or repair made without our approval.
2. Misuse, abuse, neglect, or damages caused by irresponsible use, overclocking, incorrect voltage input from improper installation, connection to other products or devices, or dismantling/removing parts.
3. Water ingress due to incorrect installation or placement contrary to ZenTunes installation guidelines.
4. Repairs or replacements will not extend or restart the warranty period.
Shipping & Delivery
Each ZenTune product is individually programmed, so it is the customers responsibility to provide all necessary information to meet deadlines. Although we strive to ensure timely delivery, unforeseen delays may occur, often due to courier or postal services.
ZenTune is not responsible for customs queries, delays, or charges. Any customs charges must be paid by the receiver before delivery. If you choose not to pay these charges and the consignment is returned, return charges will also be passed on to you.
Approved Tuning Centres
ZenTune offers customers the option to have their purchase professionally installed by an authorized partner. All authorized fitting centers are third-party approved and adhere to ZenTune standards. Your contract remains with ZenTune. This service is non-refundable in the event of a product return.
Cancellation/Rescheduling of Bookings
You may reschedule, cancel, or amend appointments (subject to availability) with one workings notice. ZenTune reserves the right to retain the fitting fee if insufficient cancellation notice is provided.
ZenTune Affiliates
ZenTune reserves the right to amend these Terms and Conditions at any time, with changes becoming effective from the date they are posted on our website or communicated via email/newsletter.
1. Commencement and Termination
This Agreement starts upon your acceptance as an Affiliate and continues until terminated. The Affiliate can terminate this Agreement immediately at any time but must stop using the service, delete all references to ZenTune, return marketing materials, and will not receive any commission on referrals made after termination. ZenTune may terminate this Agreement or suspend the Affiliate from the Program at any time. Upon termination, the Affiliate has no rights to use ZenTunes Intellectual Property Rights, including domain names, text, images, banners, or other works created by or for ZenTune.
2. Payment
The affiliate scheme runs from the 21st of each month to the 20th of the following month. Payments are made on the 25th of the following month. Cancelled sales during this period will be deducted from the total payable. To receive payment, ZenTune will notify eligible affiliates on the 21st of the amount to invoice. ZenTune must receive an invoice before payment can be made. All invoices must include full legal trading details, including VAT number if applicable.
Affiliates outside Australia receiving regular or large payments may be asked to provide information to comply with Money Laundering Regulations. Failure to comply will result in withheld payments. Affiliates are responsible for taxes and national insurance on payments received from ZenTune. Commission for returns under the 30-day policy will be canceled or reclaimed. Payments become eligible 30 days after the transaction date and will be included in the following months payment period. Refunds under the warranty period may be reclaimed up to 6 months.
3. General
Payments are made to Australian Affiliates with a minimum balance of $35 and to international Affiliates with a minimum balance of $100. Inactive accounts for 6 months may incur a variable account closing charge up to $25, not exceeding the account balance. Affiliate payments are made when funds from customers are collected. ZenTune will provide a detailed report on the 21st of each month, and Affiliates should check their reports regularly. ZenTune is not responsible for errors not reported within 4 weeks. Fraudulent activity will result in transaction reversals, and ZenTune may take legal action. In case of suspected fraud, payments will be stopped, and the Affiliate must provide additional information.
Affiliates must only distribute their specific affiliate code and will receive $35 per successful transaction.
4. Indemnification
The Affiliate shall indemnify ZenTune against claims for damages or compensation arising from their website's content or any incorrect information provided. The Affiliate will compensate ZenTune for damages or costs due to improper, negligent, or unauthorized use of ZenTune's service.
5. Liability - System Failure, Viruses, Damages, Downtime
ZenTune is not liable for defects in service, interruptions, data loss, security issues, viruses, loss of profits, contracts, reputation, or any indirect or consequential loss, whether arising from negligence, breach of contract, or otherwise.
6. Liability Limits
ZenTune does not guarantee or warrant the performance of the Affiliate program or links to other websites. ZenTune is not liable for errors or omissions in documentation or marketing materials provided to or on behalf of the Affiliate.
7. Legal Content and Approval
The Affiliate is responsible for ensuring their website complies with all applicable laws and regulations. Affiliates outside Australia must also comply with Australian laws. ZenTune logos, names, or images cannot be used without written consent.
8. Confidentiality, Waiver, and Force Majeure
(a) Confidentiality: Information disclosed by either party is proprietary, confidential, or a trade secret.
(b) Waiver: Provisions may be amended or suspended if agreed upon in writing by both parties. Waivers apply only to the specific circumstances.
(c) Force Majeure: Obligations are suspended if performance is delayed or prevented by circumstances beyond control, including government actions, war, strikes, or natural disasters.
9. Copyright / Intellectual Property
ZenTune owns all copyrights, trademarks, and intellectual property related to its service. The Affiliate does not acquire any rights or licenses under this Agreement.
10. Affiliate Information
Affiliates consent to the publication of their name and web address for marketing purposes and agree to the use of their information for statistical and promotional purposes. ZenTune may contact Affiliates for feedback and improvements.
11. Legal Age
Affiliates must be at least 18 years old. If under 18, a parent or guardian must sign up on their behalf.
12. Applicable Law
These Terms (and any Specific Terms) are governed by Australian law. Disputes will be settled through mediation as agreed in writing by the parties.
Competition General Terms & Conditions
These General Terms apply to all ZenTune competitions. Specific terms and conditions for each competition will be provided separately. General Terms may be updated, and changes will apply from the date posted. By entering any competition, you agree to these General Terms and any applicable Specific Terms.
Identity of the Promoter
ZenTune, the promoter of the competitions, is registered in Australia. Concerns should be addressed to ZenTunes contact address, with details of the competition and issue.
Eligibility Rules
Competitions are open to residents of Australia unless otherwise specified. Parents or guardians of entrants under 18 must confirm acceptance of terms and prizes. Additional eligibility requirements will be published as needed.
Entry and Entry Methods
Entry may involve premium rates or SMS. Charges and eligibility are subject to network provider terms. Invalid entries or those not meeting criteria will be rejected. Automated or multiple entries are prohibited.
Copyright
Entrants assign all rights in their entry to the promoter and confirm that their entry does not breach third-party rights. They indemnify the promoter against any claims related to the entry.
Laws
These General Terms are governed by Australian law. Any unenforceable provisions will be severed, and the remaining terms will remain in effect.
